Ukraine: Comparative Note on Disciplinary Liability and Proceedings Against Judges of Constitutional Courts
On 26 January 2026, the Acting Chair of the Constitutional Court of Ukraine sent to the OSCE Office for Democratic Institutions and Human Rights (hereinafter “ODIHR”) a request for expert legal advice on several issues pertaining to disciplinary liability and proceedings against constitutional court judges.
This Note was prepared in response to the above request and aims to outline key principles related to the above topic with a view to inform possible policy and/or legislative choices for reform. Since the request also lists a number of specific issues for which the requestor is seeking ODIHR’s guidance, the present Note also seeks to address such issues. ODIHR conducted this assessment within its mandate to assist the OSCE participating States in the implementation of their OSCE human dimension commitments.
